When the former president left office on 1/20/21, he no longer had the official capacity that allowed him to keep government documents. He refused a subpoena, and was charged related to the Espionage Act of 1917. The Presidential Records Act no longer applied, he was no longer in office, and was charged for his willful misconduct.

Trump has no actual defense in the case but a sypathetic judge to agree with Trump’s Presidential Records Act claims to dismiss the case.
